Nashville, TN.

Depending on various factors, such as whether or not someone died with a will and/or what type of property they owned when they passed, their heirs may need to avail themselves of the probate courts. Morgan Dale, PLLC is an experienced law firm and has guided many local clients through what can be a complex and confusing process.

Probate is a court process that is used to facilitate or carry out an individual’s wishes as outlined in their will after their death. In most cases a person who passes with a will names an executor of their estate. The executor is the administrator of the estate and he or she is tasked with carrying out the deceased’s wishes as outlined in their will. Usually the named executor retains an attorney to help them through the probate process and act as their probate representative.

In cases where the decedent dies without a will (intestate) then Tennessee state law will determine what the decedent’s heirs are entitled to receive. Depending on the amount and type of property they own, they may need the assistance of the probate court in order to have a personal representative named to administer the estate to pay debts and distribute the assets of the estate according to Tennessee intestacy law.
